By accessing and using ProAgentive ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use our Service.

2. Description of Service

ProAgentive provides an AI-powered chat agent platform that allows businesses to deploy automated chat agents on their websites and WhatsApp. Our service includes agent creation, training, deployment, analytics, and integrations.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account and all activities that occur under it. Notify us immediately of any unauthorized use.

4. Payment Terms

• Our service operates on a pay-per-use wallet system
• Wallet balance never expires
• Payments are processed securely via Razorpay
• All prices are in Indian Rupees (INR) and inclusive of applicable taxes
• Refunds are processed per our Refund Policy within 7 business days

5. Acceptable Use

You agree not to use the Service to:

• Send spam or unsolicited messages
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute harmful, offensive, or illegal content
• Impersonate any person or entity
• Interfere with the proper functioning of the Service

6. WhatsApp & Meta Compliance

When using WhatsApp integration, you agree to comply with Meta's Terms of Service, WhatsApp Business Policy, and all applicable messaging regulations. You are solely responsible for the content sent through your WhatsApp integration.

7. AI Content Disclaimer

Our AI agents generate responses based on information you provide. We do not guarantee the accuracy of AI-generated content. You are responsible for reviewing and validating AI responses before deploying agents for critical business use.

8. Intellectual Property

The Service and its original content are the exclusive property of ProAgentive. You retain ownership of content you upload to train your agents. By uploading content, you grant us a license to use it to operate the Service.

9. Limitation of Liability

ProAgentive shall not be liable for any indirect, incidental, special, or consequential damages. Our maximum liability shall not exceed the amount paid by you in the last 3 months.

10. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by factors outside our control.

11. Termination

We may terminate or suspend your account for violations of these Terms. You may cancel your account at any time. Upon termination, your data will be deleted after 30 days.

12. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be resolved in the courts of India.
